1. ABOUT THESE TERMS AND WHO THEY APPLY TO
1.1 These Candidate and General User Terms of Use ("Terms") govern access to and use of Eternity Job by individuals who browse or otherwise use the Platform, including unregistered visitors and Candidates who create an account, search for jobs, maintain a Candidate Profile, receive job recommendations or invitations, communicate through the Platform or apply for employment opportunities.
1.2 These Terms are between you and Eternity Connect Sdn. Bhd. (Registration No. 202601023199 (1685296-V)) ("Eternity Connect", "Eternity Job", "we", "us" or "our"), which owns and operates Eternity Job as an online employment marketplace and technology platform. Agensi Pekerjaan Eternity Sdn. Bhd. (Company No. 202401030424 (1576273-D)), a related company and licensed private employment agency in Malaysia ("Eternity Recruitment"), provides separate recruitment, sourcing, placement and related services. Eternity Recruitment is not a party to these Terms unless expressly stated in connection with a separate service or arrangement.
1.3 By accessing or browsing any public part of the Platform, you agree to comply with the provisions of these Terms that apply to general users. By creating a Candidate Account, clicking an acceptance mechanism, submitting an application or otherwise using a feature that requires acceptance of these Terms, you agree to be bound by these Terms as a contract to the extent permitted by applicable law. If you do not agree, you should not create an account or use the relevant services.
1.4 Employer accounts, paid employer products, job-advertising services, Candidate-search tools and other employer-facing services are subject to separate Employer Terms of Use and any applicable order form or product terms. If you use both Candidate and Employer services, the terms applicable to the relevant capacity and service will apply.
1.5 Our Privacy Policy / Personal Data Protection Notice ("Privacy Notice") explains how Personal Data is handled in connection with the Platform. The Privacy Notice applies alongside these Terms and does not limit any right you have under the Personal Data Protection Act 2010 [Act 709] ("PDPA") or other applicable law.
1.6 Additional terms may apply to a particular feature, campaign, assessment, verification service, promotion, paid optional service or separate recruitment service. In particular, if you elect to use recruiter-led sourcing, placement or other recruitment services provided by Eternity Recruitment, those services may be subject to separate terms, notices or arrangements with Eternity Recruitment. Where additional terms expressly state that they prevail over these Terms for that feature or service, those additional terms will apply to the extent of any inconsistency.
2. DEFINITIONS
“Candidate” means an individual who uses the Platform for the purpose of seeking, considering or applying for employment or career opportunities, or who creates or maintains a Candidate Profile.
“Candidate Account” means a personal account registered by a Candidate on the Platform.
“Candidate Profile” means the profile, career, skills, preferences and other information associated with a Candidate Account and made available through the Platform in accordance with the Candidate’s settings and activities.
“Employer” means an organisation, employer, recruiter, hiring business or authorised representative that uses Eternity Job or a related service to advertise, source, assess or recruit candidates.
“Eternity Group” means Eternity Connect, Eternity Recruitment and their respective holding companies, subsidiaries, related corporations, affiliates, associated companies and entities under common ownership or control from time to time.
“Eternity Recruitment” means Agensi Pekerjaan Eternity Sdn. Bhd. (Company No. 202401030424 (1576273-D)), a related company of Eternity Connect and a licensed private employment agency in Malaysia.
“Eternity Job” means the online employment marketplace and technology platform operated by Eternity Connect Sdn. Bhd. under the name “Eternity Job”, including the website at www.eternityjob.com and any related website, application, portal, software, feature or service made available through or in connection with that platform from time to time.
“Platform” means www.eternityjob.com and any related website, mobile application, portal, interface, software, database, communication feature, AI-enabled feature or other service operated by or for Eternity Job from time to time.
“Services” means the job-search, Candidate Profile, application, matching, communication, career and related online marketplace and technology services and features made available by Eternity Connect through the Platform. Unless expressly stated, the Services do not include recruiter-led sourcing, placement or other licensed private employment agency services separately provided by Eternity Recruitment.
“User Content” means any information, text, CV, resume, document, photograph, image, audio, video, message, response, feedback or other material that you upload, submit, post, send, create or otherwise make available through the Platform.
“you / your” means the person accessing or using the Platform, including an unregistered visitor or Candidate, as the context requires.
3. ELIGIBILITY AND ACCESS TO ETERNITY JOB
3.1 The Platform is intended for genuine career and employment-related use. You may browse publicly available pages without a Candidate Account, subject to these Terms.
3.2 To create a Candidate Account, you must be at least sixteen (16) years old and legally permitted to seek the type of employment for which you use the Platform. Certain jobs may lawfully require a higher minimum age, particular qualifications, licences, immigration status or other eligibility requirements.
3.3 If you are under eighteen (18), you should use the Platform only to the extent permitted by applicable law and with the involvement or consent of a parent or legal guardian where such consent is required. We may restrict access to particular features or request reasonable evidence of age, consent or eligibility where appropriate.
3.4 You may not create an account for another person, apply for a job on behalf of another person, impersonate another person or permit another person to use your Candidate Account.
3.5 Access to some Services may depend on your location, legal work status, device, account status, verification status or other eligibility criteria. We may limit or vary features available to different Users where reasonably necessary for legal, security, product or operational reasons.
4. CANDIDATE ACCOUNTS AND ACCOUNT SECURITY
4.1 A Candidate Account is personal to you. Unless we expressly permit otherwise, each Candidate should maintain only one active Candidate Account.
4.2 You must provide accurate, complete and current registration information, including a valid email address, and keep your information reasonably up to date. We may require verification of your email address or other account information before enabling some features.
4.3 You are responsible for keeping your password, passkey, login link, authentication credential and other account-access information confidential. Do not share your login credentials with another person.
4.4 You must notify us promptly if you suspect that your Candidate Account has been accessed without permission, your login credentials have been compromised, or there has been any other security incident affecting your account.
4.5 You are responsible for activities carried out through your Candidate Account to the extent those activities result from your use of, or failure to reasonably safeguard, your account credentials.
4.6 We may require you to reset credentials, complete additional verification, terminate active sessions or take other reasonable security steps where we suspect compromise, misuse or unusual activity.
5. CANDIDATE PROFILES, CVS AND INFORMATION YOU PROVIDE
5.1 Your Candidate Profile, CV, application information, credentials, qualifications, employment history, skills and other information you provide must be genuine, accurate, complete in all material respects, current and not misleading.
5.2 You must not claim a qualification, professional licence, work experience, employment position, salary history, work-right status or other credential that you do not genuinely hold or that is materially inaccurate.
5.3 You are responsible for reviewing information extracted, suggested or pre-filled from your CV or another source before saving, publishing or submitting it. You remain responsible for the final information in your Candidate Profile and applications, even where an automated or AI-enabled feature assisted in preparing it.
5.4 You must have the necessary rights and permissions to upload or provide all User Content, including photographs, portfolio material, certificates and documents that belong to or contain information about another person.
5.5 Where you provide referee details or other Personal Data relating to another individual, you should ensure that you are authorised to provide that information and that any consent required by law has been obtained.
5.6 We may request or facilitate reasonable verification of information you provide, including identity, qualifications, licences, work eligibility or references. A verification status or badge, if offered, confirms only the scope of the verification actually performed and is not a general guarantee of your suitability, character or employability.
5.7 We may correct obvious formatting issues, standardise information, or remove or restrict User Content that breaches these Terms, applicable law or Platform rules. We are not responsible for independently checking every statement made in a Candidate Profile or CV.
6. PROFILE VISIBILITY, APPLICATIONS AND EMPLOYER ACCESS
6.1 The Platform may offer settings that determine whether and how verified Employers can find or view your Candidate Profile. The default setting may be hidden or otherwise restricted, as described in the Platform and our Privacy Notice. You are responsible for reviewing and selecting the visibility setting that suits you.
6.2 Changing a visibility setting affects future Platform access, but it cannot recall information already disclosed to an Employer, included in an application, downloaded in accordance with the Platform, or otherwise lawfully retained by a recipient.
6.3 When you apply for a job through Eternity Job, the relevant Employer may receive the information shown in the application flow, which may include your name, contact details, Candidate Profile, answers, cover note, CV and other application material. Submitting an application authorises us to transmit that application to the relevant Employer.
6.4 You may be able to withdraw an application through the Platform. Withdrawal tells the Employer that you no longer wish to proceed, but does not “unsend” or erase information already received or lawfully retained by the Employer.
6.5 Where a Candidate-search or invitation feature is available, verified Employers may be able to view Candidate information according to the visibility setting you selected and may invite you to consider or apply for a vacancy. An invitation is not an offer of employment and does not guarantee an interview or further contact.
6.6 An Employer that receives your application or other Candidate information may act as a separate data controller for its subsequent recruitment and employment-related processing. Its use of your Personal Data may be subject to its own privacy notice, policies and legal obligations.
7. JOBS, EMPLOYERS AND THE RECRUITMENT PROCESS
7.1 Eternity Job is an online employment marketplace through which Employers may advertise opportunities and Candidates may discover, consider and apply for them. Eternity Connect provides and operates the Platform and its self-service marketplace and technology features. Unless expressly stated for a separate service, Eternity Connect does not itself provide recruiter-led sourcing or placement services under these Terms, is not the employing entity, does not make an Employer’s final hiring decision and is not a party to any employment contract entered into between you and an Employer. Separate recruitment, sourcing or placement services may be provided by Eternity Recruitment under separate terms or arrangements.
7.2 We may verify certain Employer information before enabling particular Employer functions. Verification is intended to reduce misuse of the Platform but is not an endorsement, recommendation, credit assessment or guarantee of the Employer, its business, workplace, job advertisement or hiring practices.
7.3 Employers are responsible for the content, accuracy, legality and availability of their job advertisements and for the recruitment decisions they make. We may review, refuse, edit, suspend or remove job advertisements, but we do not guarantee that every advertisement is complete, error-free, still available or represents a vacancy that has not already been filled.
7.4 You are responsible for deciding whether to apply for, interview with, accept or continue with any opportunity. You should independently consider the Employer, job duties, remuneration, location, employment terms, immigration or work-right requirements and any other matter important to you.
7.5 We do not guarantee that using the Platform will result in a match, interview, offer, placement, employment, particular salary, visa, work permit or other outcome.
7.6 Where a job application or hiring process is completed on an Employer’s own website or another third-party system, that third-party service may have its own terms and privacy practices. We do not control the operation of that external service.
8. JOBSEEKER FEES, SCAMS AND SAFE USE
8.1 Eternity Job does not charge Candidates a fee merely to submit a standard job application through the Platform. If we introduce an optional paid Candidate service in the future, its price and additional terms will be clearly disclosed before purchase and the existence of that optional service will not make payment a condition of applying for ordinary jobs unless expressly and lawfully stated.
8.2 You should exercise caution when dealing with persons you meet through an online recruitment platform. Do not make a payment, deposit, purchase, transfer of cryptocurrency or other financial commitment merely to secure a job application, interview or purported offer unless you have independently confirmed that the request is legitimate and lawful.
8.3 Be cautious if someone unexpectedly requests passwords, one-time passwords, banking credentials, payment-card details, identity documents or other sensitive information. Legitimate onboarding may require certain documents after a genuine hiring process, but you should verify the recipient and purpose before providing them.
8.4 If you encounter a suspicious job advertisement, message, payment request, impersonation, phishing attempt or other suspected scam, stop engaging where appropriate and report the matter to us through the available reporting channel or the contact details in Section 22.
8.5 We may investigate reports, restrict or remove content, suspend accounts and cooperate with law-enforcement or regulatory authorities where reasonably necessary or required by law. Reporting a matter does not guarantee a particular outcome.
9. AI-ENABLED AND AUTOMATED FEATURES
9.1 The Platform may make available artificial-intelligence, machine-learning, matching, recommendation, CV-parsing, summarisation, classification or other automated or semi-automated features ("AI Features") from time to time. Some AI Features may be optional and others may operate as part of search, matching, safety or service-improvement functions.
9.2 AI Features may, for example, help extract or suggest information from a CV, recommend jobs, identify potential relevance between a Candidate and a vacancy, generate or summarise content, assist with search or detect fraud, abuse or security risks. The features actually in use at a particular time will depend on the Platform functionality then available.
9.3 AI-generated or automated outputs may be inaccurate, incomplete, outdated, biased or missing relevant context. You should independently review any output before relying on it or submitting it as part of your Candidate Profile, application, communication or other User Content.
9.4 AI Features are intended to assist, not replace, appropriate human assessment in recruitment. Unless clearly stated otherwise and permitted by law, Eternity Job does not intend an AI-generated recommendation or flag to constitute the final decision whether an Employer should shortlist, interview, hire or reject a Candidate. Final hiring decisions are made by the relevant Employer.
9.5 Your use of AI Features, and any Personal Data processed through them, is subject to our Privacy Notice and any feature-specific notice or consent presented to you. We may retain records of interactions and outputs where reasonably necessary to provide, secure, evaluate or improve the relevant feature, subject to applicable law.
9.6 You must not deliberately provide false or manipulated information to an AI Feature, attempt to extract confidential system prompts or model information, use automated means to overload or probe an AI Feature, or use the Platform, Profiles, job advertisements or other Platform data to build or train a machine-learning or AI model without our prior written permission.
9.7 We may modify, retrain, replace, limit or discontinue an AI Feature where reasonably necessary for legal, safety, product, technical or operational reasons.
10. COMMUNICATIONS AND NOTIFICATIONS
10.1 We may send communications reasonably necessary to operate your Candidate Account or provide Services, including email verification, login or security messages, password-reset messages, application-related communications, changes to these Terms or the Privacy Notice, and important Platform or legal notices.
10.2 Depending on your settings and consent, we may also send job alerts, career content, employer invitations, surveys, events, newsletters or promotional communications. You may manage available preferences or unsubscribe from direct marketing where applicable. Opting out of marketing does not prevent essential account, security, legal or transaction-related communications.
10.3 If the Platform provides messaging between you and an Employer, communications may be accessible to authorised members of that Employer’s hiring team and may be retained as part of the relevant application or recruitment record. If you report a message, authorised Eternity Job personnel may review information reasonably necessary to investigate the report.
10.4 You are responsible for keeping your contact details current so that we can communicate with you effectively.
11. USER CONTENT AND PERMISSIONS YOU GIVE US
11.1 As between you and us, you retain ownership of intellectual property rights you hold in your User Content. These Terms do not transfer ownership of your CV, photograph, portfolio, messages or other original User Content to us.
11.2 You grant Eternity Connect and members of the Eternity Group a worldwide, non-exclusive, royalty-free licence, for so long as reasonably necessary, to host, store, reproduce, format, convert, adapt for technical compatibility, index, analyse, display, transmit and otherwise use your User Content solely to operate, secure, administer, provide and improve the Platform and the Services and, where you elect or authorise such services, to support related recruitment services provided by Eternity Recruitment, subject to your applicable privacy and visibility settings, our Privacy Notice and applicable law.
11.3 The licence in Section 11.2 includes permission to transmit your User Content to an Employer when you apply, to display appropriate Candidate Profile information to Employers according to your visibility settings, and to process your content using service providers or technology needed to provide the Services.
11.4 If you remove User Content or close your Candidate Account, our active use of that content will cease within a commercially reasonable period, subject to copies already disclosed to Employers, statutory or regulatory retention, dispute or security records, lawful backups, technical deletion cycles and anonymised information that no longer identifies you.
11.5 You represent that your User Content and our permitted use of it under these Terms will not infringe another person’s intellectual property, privacy, confidentiality, image, data-protection or other legal rights.
11.6 If you provide suggestions, ideas or feedback about the Platform, you permit us to use that feedback without restriction or payment to improve or develop our services, provided that we do not publicly identify you as the source without permission unless permitted by law.
12. OUR PLATFORM, CONTENT AND INTELLECTUAL PROPERTY
12.1 The Platform, its software, databases, layout, design, branding, logos, compilations, functionality and content created by or for Eternity Job are protected by intellectual property and other laws. Except for User Content and third-party content, all rights in those materials are owned by or licensed to us.
12.2 Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Platform for your personal, non-commercial career and employment-search purposes.
12.3 You may view job advertisements and other public Platform content and may save or print a reasonable copy for your own personal job-search use. You may share a normal link to a public job or company page. You may not reproduce, republish, sell, sublicense, create a competing database from, or commercially exploit Platform content without our prior written permission.
12.4 No right is granted to use the Eternity Job name, logo, trade marks or branding except as expressly authorised by us.
13. ACCEPTABLE USE AND PROHIBITED CONDUCT
13.1 You must use the Platform lawfully, honestly, responsibly and for genuine career, employment or related personal purposes.
13.2 You must not, directly or through another person, script, bot, automated system or service:
- scrape, crawl, harvest, data-mine, bulk copy, export, reproduce or systematically collect job advertisements, Candidate Profiles, contact details, company information or other Platform data, except through an interface or API expressly authorised by us and in accordance with its terms;
- use Platform data, Profiles, job advertisements, messages or other content to create, train, fine-tune, validate or improve an AI or machine-learning model without our prior written permission;
- probe, scan, test, circumvent or attempt to defeat any authentication, access control, rate limit, anti-bot measure, security control or technical restriction;
- access data, systems, accounts or areas of the Platform that you are not authorised to access;
- interfere with, overload, damage, disable or impair the Platform or another User’s use of it, including by flooding, spamming or introducing malware, viruses, scripts or destructive code;
- impersonate another person or organisation, misrepresent your identity, employment history, qualifications, affiliations or authority, or create a false or deceptive account;
- create multiple accounts or use another account to evade a suspension, restriction, rate limit, verification requirement or enforcement action;
- post, transmit or store material that is unlawful, fraudulent, defamatory, threatening, harassing, hateful, obscene, malicious, discriminatory in breach of applicable law, or that infringes another person’s rights;
- send unsolicited marketing, promote unrelated products or services, solicit money from other Users, or use the Platform as a contact list for commercial prospecting;
- upload files that are materially different from what they purport to be, contain malicious code, or are designed to compromise another person or system;
- delete, alter or interfere with content belonging to another User without authority;
- reverse engineer, decompile or attempt to derive source code, non-public APIs, models or underlying components of the Platform except to the extent such restriction is prohibited by law;
- resell, sublicense, rent, assign or commercially exploit access to a Candidate Account or the Platform; or
- use the Platform for any unlawful activity, scam, deceptive practice or purpose inconsistent with these Terms.
13.3 We may use reasonable technical and organisational measures, including rate limiting, logging, traffic analysis and access controls, to detect and prevent scraping, abuse, fraud, security threats and other prohibited use.
14. THIRD-PARTY WEBSITES, SERVICES AND INTEGRATIONS
14.1 The Platform may contain links to, or integrate with, third-party websites, Employer career pages, assessment systems, identity-verification services, maps, social-media services, payment providers, communication tools or other services that we do not control.
14.2 A link or integration does not mean that we endorse or guarantee the third party, its content, security, products, hiring practices or services. Your use of a third-party service may be subject to that third party’s own terms and privacy notice.
14.3 To the extent permitted by law, we are not responsible for loss caused by your independent dealings with a third party, except to the extent the loss results from our own breach of an obligation that cannot lawfully be excluded or limited.
15. PERSONAL DATA AND PRIVACY
15.1 Our Privacy Notice explains the categories of Personal Data processed in connection with Eternity Job, where it comes from, why it is processed, who may receive it, AI and automated processing, cross-border transfers, retention, security, your rights and how to contact us about privacy matters. It also explains the respective roles of Eternity Connect and Eternity Recruitment, including circumstances in which Personal Data may be shared with or separately processed by Eternity Recruitment.
15.2 Where the PDPA requires consent or explicit consent for a particular processing activity, we may obtain that consent through an appropriate separate or feature-specific mechanism. Accepting these Terms does not by itself mean that every processing activity is based solely on consent.
15.3 Your privacy and profile-visibility settings form an important part of how Candidate information is made available through the Platform. You should review those settings and our Privacy Notice before making your profile discoverable or submitting an application.
16. AVAILABILITY, CHANGES AND MAINTENANCE OF THE PLATFORM
16.1 We aim to keep the Platform available and functioning, but we do not guarantee uninterrupted, continuous, error-free or virus-free access. The Platform may be unavailable due to maintenance, updates, outages, security incidents, telecommunications failures, third-party systems or circumstances beyond our reasonable control.
16.2 We may add, change, replace, limit or discontinue a feature or Service where reasonably necessary for product, legal, regulatory, security, technical or business reasons. Where a change materially affects a paid optional Candidate service, any additional terms governing that service will apply.
16.3 Information on the Platform may contain errors, omissions or outdated information. You should keep your own current copy of important CVs, documents and information and should not rely on the Platform as your sole storage or record-keeping system.
16.4 We may conduct planned or emergency maintenance and may temporarily restrict access without liability where reasonably necessary to protect the Platform, Users or systems, subject always to rights that cannot be excluded by law.
17. SUSPENSION, RESTRICTION AND TERMINATION
17.1 You may stop using the Platform at any time and may close or request closure of your Candidate Account using an available account function or by contacting us.
17.2 Closing your Candidate Account does not withdraw or erase an application already transmitted to an Employer. Information may also be retained where required or permitted under the Privacy Notice, applicable law, security needs, dispute records or backup cycles. Where information has already been disclosed to Eternity Recruitment, an Employer or another authorised recipient, that entity may separately retain it where required or permitted by its own legal, regulatory or legitimate record-keeping obligations.
17.3 We may immediately suspend, restrict, remove content from or terminate an account where we reasonably believe this is necessary because of:
- fraud, impersonation, a scam, unlawful activity or a serious breach of these Terms;
- conduct that threatens the security, integrity, performance or availability of the Platform or another User;
- a legal, regulatory, court, law-enforcement or licensing requirement;
- unauthorised scraping, automated access, account sharing or circumvention of technical controls;
- materially false or misleading Candidate information or misuse of the recruitment process; or
- a need to prevent harm, protect rights, investigate misconduct or preserve evidence.
17.4 For a breach that is capable of remedy and does not require immediate action, we may give you a reasonable opportunity to remedy the breach before terminating your Candidate Account. We are not required to do so where delay could cause harm, create legal or security risk, or undermine an investigation.
17.5 We may close or archive accounts after a prolonged period of inactivity, subject to reasonable notice where practicable and our data-retention obligations.
17.6 Termination or closure does not affect rights, liabilities or provisions that by their nature are intended to continue, including provisions concerning intellectual property, User Content already disclosed, liability, governing law and accrued rights.
18. DISCLAIMERS AND LIMITATION OF LIABILITY
18.1 Nothing in these Terms excludes, restricts or modifies any guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified, including rights under applicable consumer-protection, data-protection and other mandatory laws.
18.2 Subject to Section 18.1 and to the maximum extent permitted by law, the Platform and free Candidate Services are provided on an “as available” basis. We do not warrant that every job advertisement, Employer statement, Candidate recommendation, search result, AI output or third-party communication is accurate, complete, current, suitable or free from error.
18.3 We are not responsible for the final acts, omissions, hiring decisions, workplace conduct, employment terms or representations of an Employer, or for the acts or omissions of a third-party service, except to the extent responsibility arises from our own breach of a legal obligation that cannot be excluded or limited.
18.4 You acknowledge that dealing with persons found online carries risks, including fraud, misrepresentation, phishing and other misconduct. Our verification and moderation measures reduce but do not eliminate these risks. You should exercise reasonable caution and independent judgment.
18.5 Subject to Section 18.1 and to the maximum extent permitted by law, we will not be liable for indirect, incidental, special or consequential loss, loss of opportunity, loss of anticipated income, loss of profits, reputational loss or loss of data arising from or relating to your use of the Platform, except where such exclusion would be unfair or unenforceable under applicable law.
18.6 If we are legally liable to you in connection with these Terms and that liability may lawfully be limited, our aggregate liability for all claims arising from free Candidate or general-user use of the Platform will not exceed RM500. If the claim relates to an optional paid Candidate service, the applicable cap will be the greater of RM500 and the amount you paid for that service in the twelve (12) months preceding the event giving rise to the claim. This Section does not apply to liability that cannot lawfully be capped, including liability arising from fraud or wilful misconduct, or any other liability which applicable law requires to remain unlimited.
18.7 Nothing in these Terms requires you to indemnify us for our own negligence, breach of law or misconduct. You remain responsible, however, for losses and third-party claims to the extent directly caused by your unlawful User Content, fraud, deliberate misuse of the Platform or infringement of another person’s rights.
19. CHANGES TO THESE TERMS
19.1 We may amend these Terms from time to time to reflect changes in law, regulation, security, technology, Platform functionality, business structure or our Services. The current version will be made available on the Platform and will state the date it was last updated or became effective.
19.2 Where a change materially affects registered Candidates’ rights or obligations, we will provide reasonable advance notice through the Platform, email or another appropriate channel where reasonably practicable, unless an earlier change is required by law, security or urgent operational necessity.
19.3 If you do not agree to an amended version, you should stop using the affected Services and close your Candidate Account before the amended Terms take effect. Continued use after the effective date of the amended Terms constitutes acceptance to the extent permitted by law.
20. GOVERNING LAW AND DISPUTES
20.1 These Terms are governed by the laws of Malaysia.
20.2 Subject to any statutory right to bring a claim before a competent tribunal or authority, the courts of Malaysia will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Platform.
20.3 Before commencing court proceedings, you may contact us so that we can try to resolve the issue informally. This does not prevent either party from seeking urgent relief or exercising a statutory right or remedy.
21. GENERAL PROVISIONS
21.1 These Terms, together with any additional terms that expressly apply to a particular Candidate feature or service, constitute the agreement governing your use of the relevant Platform Services. The Privacy Notice is a separate notice concerning Personal Data and statutory privacy rights.
21.2 You may not transfer your Candidate Account or assign your rights or obligations under these Terms to another person without our written consent.
21.3 We may assign, transfer or novate our rights or obligations under these Terms to a member of the Eternity Group or a successor to the relevant business, provided that this does not materially reduce your non-excludable legal rights. We will give reasonable notice where required by law or where the change materially affects you.
21.4 If any provision of these Terms is held invalid or unenforceable, that provision will be interpreted or severed to the minimum extent necessary, and the remaining provisions will continue in effect.
21.5 If we do not enforce a right immediately, that does not waive the right. A waiver is effective only for the particular matter for which it is given.
21.6 We are not liable for delay or failure to perform an obligation caused by circumstances beyond our reasonable control, except for obligations that applicable law does not permit us to exclude or suspend.
21.7 Nothing in these Terms creates an employment relationship, partnership, joint venture, fiduciary relationship or agency between you and Eternity Job merely because you use the Platform.
21.8 We may give notices electronically through the Platform, your registered email address or another contact method associated with your Candidate Account. You are responsible for keeping those details current.
21.9 These Terms may be published in English and Bahasa Malaysia. Both versions are intended to have the same meaning. If there is an inconsistency, the English version will prevail to the extent permitted by law.
